1. Acceptance of Terms

By accessing or using Rosevari ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Rosevari provides an AI-powered virtual receptionist service for trade and service businesses. Our service includes:

  • Automated phone call answering using AI voice technology
  • Appointment scheduling integrated with Google Calendar
  • SMS notifications for bookings and urgent calls
  • Call transfer for urgent situations
  • Dashboard for managing calls and bookings

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old or the age of majority in your jurisdiction
  • Have authority to bind your business to these terms

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to make harassing or fraudulent calls
  • Resell or redistribute the Service without authorization

5. AI Service Limitations

You acknowledge that:

  • Our AI assistant may occasionally misunderstand callers or make errors
  • The Service is not a replacement for emergency services (000)
  • Call quality depends on caller's phone connection and environment
  • We do not guarantee 100% uptime or availability

6. Payment Terms

Subscription fees are billed monthly in advance. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice.

7. Third-Party Services

The Service integrates with third-party services including:

  • Google Calendar (for scheduling)
  • Vapi (for voice AI)
  • Telnyx (for phone and SMS)

Your use of these integrations is subject to their respective terms of service.

8. Intellectual Property

The Service, including its design, features, and content, is owned by Rosevari and protected by intellectual property laws. You retain ownership of your business data and content.

9. Limitation of Liability

To the maximum extent permitted by law, Rosevari shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the Service will be suspended
  • You may request export of your data within 30 days
  • Outstanding fees remain payable

12. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria, Australia.

13. Changes to Terms

We may modify these terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance.
